V. ISSUANCE OF PREMIX COMMODITY RELEASE CLEARANCE
The Sugar Regulatory Administration (SRA) was created by Executive Order
No. 18 dated May 28, 1986 to promote the growth and development of the
sugar industry through greater and significant participation of the private sector,
and to improve the working conditions of laborers.
The Production Control and Regulation Office (PCRO) is a vital operation
group that assists the Sugar Board in policy making as far as sugar regulation
is concerned. They take charge of the following:
1) process all transactions related to trading;
2) sugar production, price, stocks and withdrawals monitoring; and
3) enforce policies promulgated by the Sugar Board.
OBJECTIVES: To assist the BOC in the determination of the appropriate classificaation
of premix commodities and the corresponding import and/or in the
assessment of value-added or other taxes thereon.
LEGAL BASIS: EO 295, PMO No. 134, SRA Sugar Order 7 Series of 2001-2002, SRA
Sugar Order No. 7 Series of 2003-2004 and SRA Sugar Order No.7-A
Series of 2003-2004.
POLICY GUIDELINES:
A. Importers/Consignees of premix commodities should apply with the SRA for a
Premix Commodity Release Clearance (PCRC) prior to withdrawal thereof from
the BOC.
B. Upon ascertaining, as a result of the SRA laboratory analysis, that the importation
declared shall not fall under AHTN Tariff Heading 17.01, the SRA shall immediately
issue a PCRC for the withdrawal of the premix commodity found to be bonafide.
However, if the laboratory analysis shows otherwise (more than 65% sucrose content
and therefore misclassified), the SRA shall advise the BOC (copy furnished the importer)
in accordance with Section 3 of PMO 134, that the importation shall be classified under
AHTN 1701.91.00 or AHTN 1701.99.19. The SRA shall only issue the PCRC for the
withdrawal of the premix commodity upon submission to the SRA proof of payment
of tariff and duties under AHTN 1701.91.00 or AHTN 1701.99.19.
C. The SRA Administrator may waive, upon request, on certain shipments the requirement
of laboratory analysis if the imported premix commodities had already been subject to
SRA laboratory analysis because of previous importations such that there are established
records of same in terms of sugar content and other traceable elements/ingredients and
discernable physical appearances. Additionally, such a waiver is given after the imported
premix had been verified to be the same premix that was consistently classified by the
SRA through previous laboratory analysis and samples submitted.
D. No export sugar shall be allowed for withdrawals from the mills,
in-loading/out-loading of the ports/bulk terminals and shipment
by the Bureau of Customs without SRA Authority/Clearance.
